Terms of Service

Please read these Terms of Service (this “Agreement”) carefully because it is a binding agreement between you (“you” or “User”), on the one hand, and Rise Buys Fast (“Rise Buys Fast”), on the other hand, and it applies to your use of the website hosted on the domain https://risebuysfast.com/ and its sub-domains (the “Website”), and such other software applications and services that Rise Buys Fast makes available through the Website or otherwise, including our services for purchasing residential properties and any related services, applications, and APIs (together with the Website, the “Services”).

By accessing or using the Website, submitting your property information through any form on the Website, authenticating your email for, downloading material related to, uploading information to, and/or otherwise using the Services, you agree (1) to be bound by this Agreement, (2) that you have read and understand this Agreement and the Privacy Policy, and (3) that you are at least 18 years of age (or the legal age of majority where you reside if that jurisdiction has an older age of majority). If you do not wish to accept this Agreement, please do not access or use the Services.

Rise Buys Fast may be referred to herein as a “Party” and, together with you, as the “Parties.”

1. Changes to this Agreement

Rise Buys Fast may change, modify, add, or remove portions of this Agreement (each, an “Update”) at any time and in Rise Buys Fast’s sole discretion without prior notice, and such Updates will be effective immediately upon posting to the Website. Rise Buys Fast will change the “Updated” date above. Continued use of the Services confirms acceptance of the updated Agreement. If you do not agree to the updated Agreement, you must discontinue using the Services.

2. The Services

Rise Buys Fast is a real estate solutions company that provides homeowners with the opportunity to request and receive offers for the purchase of their residential property. Through the Services, you may submit information about yourself and your property so that Rise Buys Fast (or, in limited circumstances, one of its investor partners) can evaluate the property, prepare an offer, and communicate with you about that offer. Subject to this Agreement, Rise Buys Fast grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for their intended purpose. All rights not expressly provided are reserved to Rise Buys Fast.

3. Information You Submit

You are solely responsible for the accuracy, quality, integrity, legality, and reliability of all information you submit through the Services, including your name, contact information, and property information. You represent and warrant that: (a) you are the owner of the property you submit (or are authorized by the owner to submit information about it); (b) all information you provide is truthful and accurate to the best of your knowledge; and (c) your submission of information and our use of it as described in this Agreement and the Privacy Policy does not violate any law or any third party’s rights.

You shall not, and shall not permit others to: (i) transmit unlawful, libelous, infringing, defamatory, threatening, vulgar, obscene, or harmful material; (ii) transmit viruses or other harmful code; (iii) interfere with the Services’ integrity or performance; (iv) attempt unauthorized access to the Services or related systems; (v) use robots, spiders, or scraping methods against the Website; (vi) submit fraudulent property inquiries or impersonate another person; or (vii) use the Services for any purpose outside this Agreement. Rise Buys Fast may temporarily suspend or terminate your access to the Services, without liability, if it believes in its sole discretion that tortious, criminal, or otherwise illegal activity may be associated with your use, or that your use may breach this Agreement.

4. Offers and Transactions

Any offer made by Rise Buys Fast — whether communicated through the Website, by phone, by text message, by email, or in person — is an invitation to negotiate and not a binding contract until it is accepted and the transaction is documented in a written purchase and sale agreement (or equivalent contract) signed by both Parties. Rise Buys Fast reserves the right to withdraw, revise, or decline to make any offer at any time prior to execution of a written agreement, including as a result of new information obtained during its evaluation of the property.

All transactions are subject to customary title review, inspection, and closing conditions. Nothing in this Agreement obligates Rise Buys Fast to purchase your property, and nothing obligates you to sell, until both Parties execute a written purchase agreement. Any fees, deposits, timelines, and other terms of the sale will be stated in that written agreement, which controls over this Agreement in the event of a conflict regarding the transaction.

5. No Professional Advice

The Services, the Website, and all content on the Website are provided for informational purposes only. Rise Buys Fast does not provide legal, tax, accounting, appraisal, or financial advice through the Services. You are encouraged to consult your own attorney, accountant, or other advisor regarding the sale of your property and the legal and tax consequences of any transaction. Any statements made on the Website, in our communications, or by our representatives regarding timelines, costs, or outcomes are estimates and are not guarantees.

6. Intellectual Property Rights

All right, title, and interest in and to the Services, the Website, and “Rise Buys Fast Content” — including text, graphics, HTML, look and feel, images, illustrations, designs, photographs, audio, video, logos, icons, typefaces, format, algorithms, and other materials — and their selection and arrangement remain solely with Rise Buys Fast and its licensors. Nothing herein grants you any rights other than the limited right to access and use the Services as expressly stated in this Agreement. You shall not edit, alter, abridge, or change any content of the Services, including copyright and proprietary notices, and you may not copy, distribute, publicly display, transmit, sell, rent, lease, sublicense, or otherwise exploit the Services or Rise Buys Fast Content without Rise Buys Fast’s prior written consent.

Any “Feedback” — suggestions, ideas, enhancement requests, or recommendations — provided by you regarding the Services may be used and exploited freely by Rise Buys Fast without any compensation, and Rise Buys Fast will own all rights, title, and interest in any Feedback.

7. Consent to Communications; SMS/MMS Messaging

By submitting your information through the Website, providing a phone number, or otherwise using the Services, you consent to receive communications from Rise Buys Fast and its service providers at the telephone number(s) and email address(es) you provide. These communications may include calls, texts (SMS/MMS), and emails regarding your request, your property, offers, service updates, security alerts, appointment reminders, support communications, and promotional or marketing messages. Communications may be made using automatic telephone dialing systems and prerecorded or artificial voice messages.

Message frequency may vary. Message and data rates may apply according to your wireless carrier plan. Carriers are not liable for delayed or undelivered messages. Consent to receive text messages is not required as a condition of purchasing any property, goods, or services, and you may opt out at any time by replying STOP to any text message or by contacting us at contact@risebuysfast.com. After opting out, you may receive a final confirmation message. To receive assistance, reply HELP or contact us through the same channels. Rise Buys Fast’s use of telephone numbers is also governed by our Privacy Policy.

8. Links to Other Sites

Our Services and Website may contain links to other websites. The fact that we link to a website is not an endorsement or representation of our affiliation with that third party. We do not control third-party websites and encourage you to read the privacy policies and terms of use for the other websites you visit.

9. No Warranties

Rise Buys Fast makes no representations or warranties whatsoever, express or implied, regarding the Services. The Services are provided on an “as is” and “as available” basis with all faults and without any express, implied, or statutory warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or arising from course of performance, dealing, usage, or trade. Rise Buys Fast does not warrant that the Services will be uninterrupted or error-free, and it disclaims all liability for erroneous transmissions, loss of service from communication failures, loss of data in transmission, errors of any kind, and improper transmission. The ability to exclude warranties varies by jurisdiction; these exclusions apply to the extent permitted by law.

10. Limitation of Liability

In no event will Rise Buys Fast be liable for any incidental, indirect, consequential, special, exemplary, or punitive damages, or for lost revenues, lost profits, or other economic loss, arising from or relating to this Agreement or your use of (or inability to use) the Services, regardless of whether advised of the possibility of such damages, and even if a remedy fails of its essential purpose. In no event will Rise Buys Fast’s total aggregate liability arising out of or related to this Agreement exceed one hundred United States dollars ($100.00), except to the extent such liability arises from an executed written purchase agreement between you and Rise Buys Fast, in which case that agreement controls. No action shall be brought more than one year after the accrual of such cause of action.

11. Indemnification

You will be responsible for, and will indemnify, defend, and hold Rise Buys Fast, its affiliates, licensors, service providers, and their officers, directors, employees, and successors (“Indemnified Parties”) harmless from all damages, liabilities, charges, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (i) your use of the Services in a manner not permitted by this Agreement; (ii) your failure to comply with applicable laws; (iii) any acts or omissions by you or your breach of this Agreement; or (iv) any inaccuracy in the information you submit to the Services, including ownership of or authority over a submitted property.

12. Governing Law; Venue

This Agreement is governed by the laws of the State of New Jersey, without regard to conflicts of laws rules. Venue for any legal action arising out of or relating to this Agreement is exclusively the state or federal courts located in the State of New Jersey. Each Party irrevocably consents to such jurisdiction and waives the defense of inconvenient forum. To the maximum extent permitted by applicable law, each Party knowingly, voluntarily, and intentionally waives the right to trial by jury in any action or proceeding based on or with respect to this Agreement.

13. General Provisions

• Severability. Each provision is severable. If any term is illegal or invalid, the remainder of the Agreement remains effective.
• Waivers. No waiver is binding unless in writing signed by the Party granting the waiver. Any waiver is limited to the specific circumstance referenced and is not a waiver of any other term or recurrence.
• Assignability. Neither this Agreement nor any rights or obligations under it may be assigned by you without Rise Buys Fast’s prior written consent. The Agreement binds and benefits the Parties and their respective successors and permitted assigns.
• Force majeure. Rise Buys Fast is not responsible for failures due to events beyond its control, including acts of nature, war, riots, terrorism, crime, pandemics and epidemics, labor shortages, embargoes, postal or communication disruption, or any other event beyond its control.
• Notices. If you provide an email address, Rise Buys Fast may communicate electronically regarding administrative, security, and other issues. You agree electronic notices satisfy any legal requirement that communications be in writing.
• Entire agreement. This Agreement, together with the Privacy Policy and any executed purchase agreement, contains the entire understanding between the Parties and supersedes any prior written or oral agreements respecting its subject matter.
• Survival. Sections 4, 5, 6, 7, 9, 10, 11, and 12, and any other obligation that by its nature is intended to survive, shall survive termination of this Agreement.
